Probate Filing Fees

The estate filing fee schedule for Dorchester County Probate Court is based on estate value. The initial filing fee is $25, with remaining costs billed after the inventory is filed:

Code § 8-21-770 include $0.50 per page for copies, $5 for certified copies, $10 for filing a will only, $25 for probating a will, $150 for a Summons and Petition for Guardianship or Conservatorship, and $150 for petitions to determine heirs (non-refundable). Opening an Estate

If the decedent was a resident of Dorchester County at the time of death and passed within the last ten years, an individual may open probate without an attorney by completing the Opening Probate Worksheet available from the Estate Division. The completed worksheet and required documents must be submitted to the court, after which the estate clerk will assign a date for an Opening Probate Seminar. If more than ten years have elapsed since the decedent’s death, a formal Petition to Determine Heirs is required, which involves personal service on all heirs, a publication requirement, and a court hearing, with a $150 filing fee.
