Newberry County, South Carolina, sits in the Midlands region of the state and is part of the Eighth Judicial Circuit. The county’s court system spans multiple court levels—from the Circuit Court handling major civil and criminal matters to the Magistrate’s Court resolving smaller disputes—and each generates records that document the progress and outcome of legal proceedings. These records serve as the official account of what occurred in court and are used by attorneys, researchers, parties to litigation, employers, and members of the public for a wide range of purposes.

Public court records in South Carolina can be located through clerk offices, the courthouse in the county where a case was filed, public access computer terminals, and the state’s online case search system. SouthCarolinaCourts.us provides a resource for locating publicly available court case information across the state. Searching case records begins with knowing which court handled the matter, and this guide explains exactly where to look for each record type in Newberry County.

Are Court Records Public in Newberry County?

South Carolina law establishes broad public access rights to government records. Under Section 30-4-30(A) of the South Carolina Code of Laws, any person has the right to inspect, copy, or receive an electronic transmission of any public record held by a public body, subject to reasonable rules about timing and location. The South Carolina Freedom of Information Act reinforces this principle and applies to records held by courts and court clerks.

However, certain records are excluded from public access under Section 30-4-40. In Newberry County, the following types of records are not available to the general public:

  • Records specifically exempted from disclosure by state statute or law
  • Work product and correspondence of legal counsel representing a public body
  • Materials that would violate the attorney-client privilege
  • The identity of individuals who have filed complaints with state regulatory agencies alleging legal violations

Beyond these statutory exemptions, Newberry County Circuit Court and Family Court judges have the authority to seal individual case records. Any record sealed by court order is not available for public inspection. The clerk’s office will not provide access to sealed files regardless of how the request is submitted.

Redaction of certain personal identifiers—such as Social Security numbers and financial account information—is standard practice before public copies are issued. The South Carolina Judicial Branch’s forms library includes a Confidential Reference List of Redacted Identifiers (Form SCRCPForm6PC) for parties who need to submit documents containing such information to the court under seal.
