Are Court Records Public in Oconee County?

Oconee County Civil Court Records

Civil matters in Oconee County are handled by the Court of Common Pleas (the civil division of the Circuit Court) for disputes exceeding $7,500, and by the Magistrate Courts for claims of $7,500 or less. The magistrate courts — sometimes called small claims courts — also hear eviction and landlord-tenant disputes, claim and delivery actions, and public sales of abandoned property.

Foreclosure sales in Oconee County are handled through the Master-in-Equity division. Traffic tickets and fines at magistrate courts may be paid with money orders, certified checks, or cash. Personal checks are not accepted.

Property Records

Although not court records per se, civil judgment researchers often need to cross-reference property filings. The Oconee County Register of Deeds records deeds, mortgages, and plats. Requesting Family Court Records

Child support payment information is treated with heightened confidentiality — it is not released over the telephone and may only be obtained in person with proper identification. Child support payments in Oconee County are now processed through the South Carolina State Disbursement Unit. Marriage Records

Marriage licenses in Oconee County are issued by the Probate Court. Both parties must appear in person before 4:00 PM. South Carolina law (§ 20-1-220) imposes a 24-hour waiting period between application and license issuance. Application fees vary:

Divorce Records

Divorce records are maintained by the Clerk of Court through the Family Court. Copies can be requested in person or by mail. On the state level, divorce reports are available from the South Carolina Department of Health and Environmental Control (SCDHEC).

Birth and Death Records

Though not court records, birth and death certificates are sometimes needed in conjunction with family court proceedings. These vital records are maintained by SCDHEC Vital Records. Oconee County Probate Court Records

The Oconee County Probate Court handles estate administration, will contests, determination of heirs, guardianships and conservatorships for minors and incapacitated persons, trust matters, appointment of successor trustees, and involuntary commitment proceedings for individuals with mental illness or substance addiction.

Online Probate Search

The South Carolina Probate Record Search website provides an online index of probate cases, searchable by name and other criteria. Note that while the index is available online, document images are not currently offered for Oconee County through the online system. To obtain copies of specific documents from a probate file, visitors must go to the courthouse or submit a written request.

Types of Records Available

Probate filings commonly requested include last wills and testaments, letters testamentary, letters of administration, inventories and accountings of estate assets, petitions for appointment of guardian or conservator, and orders closing estates.
